Nothing is on sale on this website: the REDTIM ELITE is a prototype in development and no order, pre-order or payment is taken here. This policy is published in advance so the terms are known before the first sale, and it will apply to every consumer sale made by REDTIM (Alberto Salazar Peris), including the Kickstarter campaign and any later retail sale.
If you buy as a consumer at a distance, you may withdraw from the contract within 14 calendar days without giving any reason (art. 102, Spanish Royal Legislative Decree 1/2007, which transposes EU Directive 2011/83/EU).
You pay the direct cost of returning the watch when you withdraw (art. 108.1) — this notice is what the law requires us to give you in advance. If the watch is faulty or not as described, this does not apply: that is a lack of conformity and the cost is ours (see below).
You may examine the watch as you would in a shop. You are only liable for any diminished value resulting from handling beyond what is necessary to establish its nature, characteristics and functioning (art. 108.2). Please return it with its case, strap, tools, papers and packaging.
Separately from the 14-day withdrawal right, as a consumer you have a legal guarantee of conformity of three years from delivery for a new item (art. 120, as amended by Royal Decree-Law 7/2021, in force since 1 January 2022). Within that period we are liable for any lack of conformity that existed at delivery, and you may require the watch to be brought into conformity — repair or replacement — or, where the law allows, a price reduction or termination of the contract. Return and repair costs of a non-conforming watch are ours.
This legal guarantee is not affected by any commercial warranty we may offer in addition to it, and never replaces it.
The withdrawal right does not apply to the cases listed in art. 103 — for example goods made to the consumer's specifications or clearly personalised, such as a custom engraving requested by you. Any such case will be stated clearly before you order.
Buyers in the European Union have the same 14-day withdrawal right under Directive 2011/83/EU. Outside the EU, the same 14-day withdrawal period is applied by us as a matter of policy; import duties, taxes and return shipping to Spain are the buyer's responsibility.
Write to info@redtimwatches.com. Consumers resident in the EU may also use the national consumer arbitration boards (Juntas Arbitrales de Consumo) in Spain. This does not affect your right to go to court.
